1. Who We Are

BIMATRIX is a Building Information Modelling (BIM) maturity assessment platform designed for construction industry professionals in Malaysia and Southeast Asia. References to “we”, “us”, or “BIMATRIX” in this document refer to the BIMATRIX platform and its operators.

2. Information We Collect

We collect information you provide directly and information generated automatically through your use of the platform.

• Account information: Your name, email address, and (if you register with a password) a securely hashed password. If you sign in with Google, we receive your name and email from Google — we never see or store your Google password.
• Assessment data: Your answers, scores, maturity levels, and BIM assessment results across all assessment dimensions.
• Usage data: Pages visited, features used, AI assistant queries submitted, cost calculator inputs, and session timestamps.
• Communications: Any messages, feedback, or support requests you send to us.
• Technical data: Browser type, device type, IP address, and similar diagnostic information collected automatically via server logs.

3. How We Use Your Information

• To create and maintain your account and authenticate your identity.
• To provide core platform features: assessments, results history, recommendations, the AI assistant, cost calculator, and reference materials.
• To issue Certificates of Completion tied to your assessment results.
• To personalise your experience and improve platform features based on aggregate usage patterns.
• To respond to support enquiries and send platform-related communications. We do not send marketing emails without your explicit consent.
• To detect and prevent fraudulent or unauthorised use of the platform.

4. Legal Basis for Processing (PDPA Malaysia)

We process your personal data in accordance with the Personal Data Protection Act 2010 (PDPA) of Malaysia. Our legal bases for processing are: (a) performance of the contract between you and us; (b) your consent, where explicitly obtained; and (c) our legitimate interests in operating and improving the platform, provided those interests are not overridden by your rights.

5. Data Sharing and Disclosure

We do not sell, rent, or trade your personal data. We may share data only in the following limited circumstances:

• Service providers: Infrastructure providers who process data solely on our behalf under confidentiality obligations.
• Google OAuth: If you use “Sign in with Google”, authentication is handled by Google. We only receive your name and email. Google’s privacy policy governs their processing.
• Legal obligations: Where required by law, regulation, or valid government order.
• Aggregate analytics: De-identified, aggregated statistics that cannot identify any individual.

6. Data Retention

We retain your account and assessment data for as long as your account is active or as needed to provide services. Account deletion requests are processed within 30 days except where retention is required by law. Server logs are retained for up to 90 days for security and diagnostic purposes.

7. Your Rights

Subject to applicable law, you have the right to:

• Access the personal data we hold about you.
• Request correction of inaccurate or incomplete data.
• Request deletion of your account and personal data.
• Withdraw consent at any time where processing is based on consent.
• Lodge a complaint with the relevant data protection authority.

8. Cookies and Session Storage

BIMATRIX uses session cookies strictly necessary to keep you logged in. We do not use advertising or third-party tracking cookies. You can disable cookies in your browser, but this will prevent login.

9. Security

We implement HTTPS (TLS) encryption for all data in transit, bcrypt hashing for passwords, and access controls restricting database access to authorised services. No internet transmission is completely secure. You are responsible for maintaining the confidentiality of your credentials.

1. Acceptance of Terms

By registering for or using BIMATRIX you confirm that you are at least 18 years old, have the authority to enter into these Terms, and agree to be bound by them. If you are using BIMATRIX on behalf of an organisation, you represent that you have authority to bind that organisation.

2. Description of Services

BIMATRIX provides BIM maturity assessment tools including: structured assessments aligned to recognised BIM maturity frameworks; AI-assisted guidance and Q&A; a construction cost estimation calculator; curated reference materials and recommendations; and Certificates of Completion for completed assessments.

3. Account Responsibilities

• You are responsible for maintaining the security of your account credentials. Do not share your password or allow others to access your account.
• You must provide accurate, current, and complete information when registering and keep it up to date.
• You are responsible for all activity that occurs under your account.
• Notify us immediately if you suspect unauthorised access to your account.

4. Acceptable Use

You agree not to use BIMATRIX to:

• Violate any applicable local, national, or international law or regulation.
• Submit false, misleading, or fraudulent assessment responses.
• Attempt to gain unauthorised access to any part of the platform, its servers, or its data.
• Reverse-engineer, decompile, scrape, or otherwise extract data without written permission.
• Upload or transmit malicious code, viruses, or any material that is unlawful, harmful, or infringes third-party rights.
• Use the AI assistant to generate content that is deceptive, harmful, or violates any law.

5. Assessment Results and Certificates

Assessment results and Certificates of Completion are based on the information you provide. BIMATRIX does not independently verify the accuracy of your responses. Results and certificates are for informational and professional development purposes only and do not constitute a formal accreditation or statutory certification unless explicitly stated by an authorised administrator.

6. AI Assistant Disclaimer

The AI assistant draws on the platform’s curated knowledge base. Responses are generated automatically and may not always be accurate, complete, or up to date. Do not rely solely on AI responses for professional, legal, financial, or engineering decisions. Always verify critical information with qualified professionals and authoritative sources.

7. Cost Calculator Disclaimer

The construction cost calculator provides indicative estimates based on configured regional rates and GBI parameters. These estimates are for planning and reference purposes only. Actual costs will vary. BIMATRIX accepts no liability for decisions made based on cost calculator outputs.

8. Intellectual Property

All content on BIMATRIX — including assessment templates, recommendation text, reference materials, software code, and the BIMATRIX name and logo — is the property of BIMATRIX or its licensors. You are granted a limited, non-exclusive, non-transferable licence to use the platform for personal or organisational professional development. You may not reproduce, distribute, or create derivative works without prior written consent.

9. Vouchers and Access Codes

Voucher codes are single-use unless otherwise specified, non-transferable, and have no cash value. BIMATRIX reserves the right to revoke vouchers if misuse is detected or if they were obtained fraudulently.

10. Termination

We reserve the right to suspend or terminate your account if you breach these Terms or engage in fraudulent activity. You may request account deletion at any time by contacting an administrator. Upon termination, your right to access the platform ceases immediately.

11. Limitation of Liability

To the maximum extent permitted by applicable law, BIMATRIX and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. Our total aggregate liability shall not exceed the amount you paid (if any) to access the platform in the twelve months preceding the claim.

12. Disclaimer of Warranties

The platform is provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

13. Changes to These Terms

We may update these Terms and Privacy Policy from time to time. Material changes will be communicated via a notice within the platform or to your registered email address. Continued use after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of Malaysia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.
